These Terms and Conditions ("Terms") apply to your use of www.goxgrowth.com and to the services provided by Kevin Fournier, doing business as Exponential Growth ("we," "us," or "our"). By using our website or services, you agree to these Terms. If you do not agree, please do not use our website or services.

Our services

We provide marketing services for businesses, which may include local SEO, Google Business Profile management, paid advertising, website design, lead generation, automated follow up, and marketing consulting. The scope, price, and timeline of each project are set out in a written proposal, agreement, or invoice (an "Agreement"). If an Agreement conflicts with these Terms, the Agreement controls.

Free Marketing Evaluation

Our Free Marketing Evaluation is offered at no cost and with no obligation to buy. It is based on information that is publicly available or that you provide. It is for general information only and is not a guarantee of any result.

No guaranteed results

Marketing results depend on many things outside our control, including your industry, competition, budget, pricing, location, reviews, and how quickly you respond to leads. Search engines and ad platforms also change their rules and systems often. Unless an Agreement says otherwise in writing, we do not guarantee any specific ranking, number of leads, sales, or revenue. Any examples or case studies we share are not a promise that you will get the same results.

SMS Terms.

By opting in, you agree to receive text messages from Exponential Growth related to appointments, follow ups, customer care, and, if you separately consent, marketing. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out. Reply HELP for help or contact [email protected] or (207) 835-3180. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase.

Performance guarantees

If we offer you a performance guarantee, its targets, time period, and conditions will be written in your Agreement. Unless the Agreement says otherwise, a guarantee applies only if you:

Keep the ad budget and services agreed in the Agreement

Respond to leads promptly, including answering calls and returning messages

Give us the access, approvals, and information we need on time

Keep your account paid and current

A guarantee entitles you only to the remedy stated in the Agreement, such as continued work at no added fee. It is not a refund unless the Agreement says so.

Your responsibilities

You agree to:

Give us accurate information and timely access to the accounts and materials we need

Review and approve work, ads, and content within a reasonable time

Make sure that any content, logos, photos, or claims you give us are yours to use and are truthful

Follow the law in your business, including advertising, privacy, and text messaging laws for any contacts you give us

Payments

Fees, billing dates, and payment terms are set in your Agreement or invoice. Unless stated otherwise, monthly services are billed in advance and are non refundable once the month has started. Ad spend paid to Google, Meta, or other platforms is separate from our fees and is paid directly or reimbursed as agreed. We may pause work on accounts that are more than 15 days past due.

Cancellation

Unless your Agreement sets a different term, you may cancel monthly services with 30 days' written notice. You remain responsible for fees for work done and for any ad spend committed before cancellation ends.

Ownership

Once you have paid in full, you own the final deliverables we create specifically for you, such as your website content, ad copy, and graphics. You own your ad accounts, Google Business Profile, domain, and customer data. We keep ownership of our own templates, tools, methods, software, and know how, and we may use general knowledge gained from our work. With your permission, we may list you as a client or share results in our marketing.

Third party platforms

Our work relies on platforms such as Google, Meta, website builders, and CRM software. We are not responsible for their outages, policy changes, account suspensions, or decisions. Your use of those platforms is also subject to their own terms.

Confidentiality

Each of us will keep the other's non public business information confidential and use it only to perform or receive the services, except as the law requires.

Website use

You may use our website only for lawful purposes. You may not copy, scrape, or reuse our content, logos, or materials without our written permission. Website content is provided for general information only and is not legal, financial, or tax advice.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim related to our website or services will not be more than the fees you paid us in the 3 months before the claim arose.

Indemnification

You agree to protect us from claims, losses, and costs, including reasonable attorney fees, that arise from content or information you provide, your products or services, or your breach of these Terms or the law.

Disclaimer

Our website and services are provided "as is" and "as available." Except as written in an Agreement, we make no warranties of any kind, express or implied.

Governing law

These Terms are governed by the laws of the State of Maine. Any dispute will be handled in the state or federal courts located in Androscoggin County, Maine, unless we both agree otherwise in writing.

Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new effective date. Changes do not affect Agreements already signed.
